1. SCOPE OF THE PRIVACY POLICY

  • 1.1. BuildMost Service Provider (referred to as “we,” or “us”) are committed to protecting the personal information of its users (referred to as “User” or “you”). This BuildMost Privacy Policy (referred to as “Privacy Policy”) sets out how we collect, process and disclose information in connection with the operation of the Platform (defined in Section 2.1) for visitors (i.e., non-registered Platform Users) and the Users based outside of China (“you”) including personal information about the visitors and, representatives and employees of the Users. This Privacy Policy also applies to your use of the Platform via a mobile device, either through mobile applications or mobile-optimized websites.
  • 1.2. Please read this Privacy Policy carefully. If you do not agree to any part of this Privacy Policy, please discontinue accessing, browsing, or using BuildMost. By clicking “I have read and agree to the BuildMost Terms of Service and BuildMost Privacy Policy,” or by accessing, browsing, or using BuildMost, you confirm your acceptance of all Privacy Policy, effective immediately.
  • 1.3. If you are from China, please refer here to learn more about how we process your personal information. If you are from the European Union or the United Kingdom, see specific disclosures in “13. SPECIFIC PROVISIONS FOR EU, EEA AND UK USERS.” If you are from the United States, refer to “14.   • 1.4. This Privacy Policy does not apply to the extent we process personal information in the role of a processor or service provider on behalf of other companies

All capitalized terms not defined in this Privacy Policy shall have the meanings ascribed to them in the Terms of Service for the Platform, which can be found here.

2. DEFINITIONS

  • 2.1. BuildMost/ The Platform: Refers to the comprehensive industrial internet platform operated by the BuildMost service provider and its affiliates. BuildMost includes, but is not limited to, the BuildMost website ( www.buildmost.com, www.buildmost.cn, or other updated URLs as needed), accessible via computer, mobile devices, or other online access channels, as well as any related software applications (including desktop clients, mobile clients, apps, etc.). BuildMost encompasses all existing and future forms, versions, functionalities, and related services, regardless of the access method, device type, or usage scenario.
  • 2.2. BuildMost Service Provider/ We: Refers to YEKALON HK LIMITED.
  • 2.3. User/ You: Refers to individuals or entities who utilize any part or all of the services offered on BuildMost.

3. HOW DO WE PROCESS YOUR PERSONAL INFORMATION?

  • 3.1. This section outlines the specific types of personal information we collect from you, the purposes for which each type is processed, and the legal basis for processing, where applicable.
  • 3.2. If you need us to provide you with our services or fulfil a contract with you, or because we are required to do so by law, but do not provide us with your personal information, we may be unable to provide our services or fulfil our contractual obligations to you. In some instances, you may be required to provide us with personal information for processing as described below, in order for us to be able to provide you all of our services, and for you to use all the features of our Platform.
  • 3.3. For processing operations based on our legitimate interests, we have carried out a legitimate interest assessment to ensure that our interests are not prejudiced by your interests or fundamental rights and freedoms.
  • 3.4. Where relevant under applicable laws, all processing of your personal information will be justified by a “lawful ground” for processing. In the majority of cases, processing will be justified on the legal basis that:
    • 1) you have provided your consent for us to use your personal information for a specific purpose;
    • 2) our use of your personal information is necessary to perform a contract or take steps to enter into a contract with you;
    • 3) the processing is necessary to comply with a relevant legal obligation or regulatory obligation that we have (e.g. fraud prevention); or
    • 4) the processing is necessary to support our legitimate interests as a business (e.g. to improve our services to you), subject to your overriding interests and fundamental rights and provided it is conducted at all times in a way that is proportionate.
  • 3.5. Below, you will find an overview of the types of personal information we process about you, the purposes for which we process it, and the legal basis (in relevant jurisdictions only) for collecting this personal information. For users resident in a Relevant Jurisdiction, it also identifies the legal basis under which we process your data. For the purposes of this Privacy Policy, a “Relevant Jurisdiction” includes the EEA, UK, Switzerland, Brazil, Indonesia, Thailand, and Türkiye.

  • 3.6. The categories of personal information described in the table above are detailed below:
    • 1) Information You Provide

      • Contact Information: This may include the name of the contact person or legal representative, business or office address, phone number, email address for both the company and contact person/legal representative, social media account, job title, department, ID verification details, and contact’s phone number.
      • Account Information: Such as username, password, and account settings.
      • Business Information: This can include identification details, tax registration, and other business-related information, such as company name, logo, registration number and date, business type and industry, corporate registration details, and documents like business licenses and operational certificates (including qualification certificates, operating permits, etc.).
      • Transaction Information: Includes transaction records, order and payment details, and specifics about services bought or sold via the platform.
      • Payment Information: Such as bank account numbers, third-party payment account details, credit/debit card information (card number, cardholder name, expiration date, and security code).
      • Device Content Access: To facilitate your use of platform services (including optimized mobile websites and apps), we may request access to content stored on your device, like photos, videos, calendar entries, and other files. If you use platform communication tools (especially for voice communication), access to your camera and/or microphone may be required.
      • Event Information: At industry events, exhibitions, or other occasions, we may collect contact details of current or potential users, including representative names, addresses, phone and fax numbers, and email addresses.
    • 2) Information We Collect Automatically

      • Device Information: Such as device type, unique device identifier, IP address, browser type, and browsing history.
      • Online Activity Information: Includes page views, search queries, viewed or downloaded content, page or screen activity, visit time and duration, and other details of your interactions with the platform.
      • Location Information: Approximate geographic location, and, when permission is granted, approximate location from your mobile device (most mobile devices allow you to manage or disable precise location services via the settings menu).
      • Communication Information: Posts and content you share on the platform, comments on your uploaded content, and comments on content uploaded by others.
      • User-Generated Content: Includes profile photos uploaded as part of product listings, work samples, comments, or social interactions on the platform.
      • Other Information: Includes browser software, operating system, software and hardware attributes, session count, unique visitor numbers, and other statistical data.
    • 3) Information We Receive from Third Parties

      • Communication Information: Such as feedback and communication records (including exchanges with our customer service team, phone, or email records), and chat messages with other users (including instant messaging via BMostChat).
      • Third-Party Verification Information: Provided by agencies conducting anti-money laundering, anti-fraud, and “Know Your Customer” checks for buyers and sellers, including names, email addresses, company details, and contact information.
      • Information About Your Interactions with Products and Services Offered by Our Group Companies and Affiliates
      • Review and Rating Information: If you participate in reviews or ratings of BuildMost, we may obtain your personal information from third parties who partner with us to conduct service reviews and/or ratings.

4. HOW DO WE DISCLOSE OR SHARE YOUR PERSONAL INFORMATION?

  • 4.1. We will not transfer your Personal Information to third parties except as specified below, or where you consent to such transfer. Only where necessary will we share your information with selected recipients, including:
    • Related Group Companies: We share your Personal Information within our group of companies. These related group companies are only allowed to use your Personal Information in accordance with this Privacy Policy. Related companies include YEKALON INDUSTRY INC. and may only use your information as specified in this Privacy Policy.
    • Service Providers: These include SMS, VOIP, payment card processing and verification, third-party payment processor, translation, location and mapping, customer support, account data labeling, security assurance (where applicable), and content delivery service providers. These service providers are required to uphold the same or equivalent user data protection as described in this Privacy Policy and are prohibited from retaining, using, or disclosing your information except as needed to provide services to us.
    • With Other Users and Visitors: Once you register, your username, country, and other publicly available details regarding your activity become visible to all users of the platform. This includes photos you upload, your published portfolio, service listings, ratings and reviews, and additional information you choose to add to your profile. We also provide you the opportunity to participate in public forums, blogs, and other similar features. Please note that certain information, such as your username, profile details, and the content you upload, will be publicly displayed when you use these features. If you are verified as a trader, certain information may also be visible to users within the EU as required by applicable law. This includes your name, business address, email, phone number, business registration number, and your self-certification of compliance with platform policies and applicable EU regulations. Your information is also shared with other users when you send messages or communicate with them through the platform. When you publish your information or share data with other platform users, you do so at your own discretion. If you choose to share personal information with other users, including those providing services to you, this information is shared as separate data controllers. While our Terms of Service require service providers to keep shared information confidential, we cannot guarantee that all users will do so. It is your responsibility to ensure that other users meet your standards for information handling and confidentiality.
    • With Users with Whom You Interact: We share personal information to help facilitate interactions between users. For example, if you are a Buyer we may share certain information about you (such as the fact it is your first purchase on BuildMost) with the Seller to ensure the services you receive from the Seller will fit your needs; such sharing of information is limited in scope, and is intended to improve the services provided by the Seller and your user experience.
    • For Legal Reasons: We share personal information with law enforcement agencies, public authorities or other parties in order to respond to a subpoena or court order, judicial process or to regulatory authorities, if we believe we are required to do so by law, or that doing so is reasonably necessary to comply with legal processes; when we believe it necessary or appropriate to disclose personal information to law enforcement authorities, such as to investigate actual or suspected fraud or violations of law, breaches of security, or breaches of this Policy; to respond to claims against us; and to protect the rights, property, or personal safety of BuildMost, our customers, or the public.
    • For Payments and Fraud Detection: We share personal information with payment processors, fraud detection agencies and similar third parties for the purpose of facilitating payments done via BuildMost, securing BuildMost and protecting it against fraud, unauthorized transactions (such as money laundering), claims or other liabilities.
    • In The Context of a Corporate Transaction: Personal information will also be disclosed if we go through a business transition such as a merger, sale, transfer of all or a portion of BuildMost's assets, acquisition, bankruptcy or similar event. In the event that we sell any business or assets, we will disclose your data to the prospective buyer. If we or substantially all of our assets are acquired by a third party, information held by us about our users will be one of the transferred assets.
    • Third Parties Pursuant to Your Request: For example, pursuant to your data portability request.
    • Interoperability with BMostChat: BuildMost interoperates with BMostChat, enabling communication with BMostChat users. This includes exchanging messages and other features. When you interact with BMostChat users or use BMostChat-related features (collectively, “Interoperable Interactions”), we share your information with BMostChat as necessary to facilitate these interactions. Your Interoperable Interactions are also subject to the BMostChat Privacy Policy.
  • 4.2. We may provide anonymized data to third parties, but when we do so, the information we share is in a de-identified format that does not personally identify you.

5. HOW LONG DO WE KEEP PERSONAL INFORMATION?

We apply a general rule of keeping personal information only for as long as is required to perform the purpose for which it was collected. However, in some circumstances, we will retain your personal information for longer periods of time. We will retain personal information for the following purposes:

  • as long as it is necessary and relevant for our operations, e.g. so that we have an accurate record of your dealings with us in the event of any complaints or challenges;
  • in relation to personal information from closed accounts to comply with applicable laws, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigation, enforce our Site terms and take other actions as permitted by law;
  • to comply with statutory or other obligations to which BuildMost is subject to; and
  • if and to the extent necessary, we need it to preserve evidence within the statutes of limitation.

6. INTERNATIONAL TRANSFERS OF PERSONAL INFORMATION

  • 6.1. We will store the personal information collected from you through the Platform in Hong Kong. As a cross-border platform operating globally, there are certain instances where the international transfer of user personal information is necessary. Your personal information may be processed by us or by our trusted third-party providers outside of your country of residence, including in the People’s Republic of China and other countries with data protection and privacy laws or regulations that may be comparable to, or as protective as, those in your country. In line with applicable data protection and privacy laws and regulations, we will implement appropriate measures to ensure that your personal information remains protected and secure when transferred to a jurisdiction with lower data protection standards. Such measures may include, where applicable, transferring data pursuant to agreements containing standard data protection clauses.
  • 6.2. Where permitted by applicable data protection and privacy laws, we may transfer your personal data outside your country to conduct big data analysis aimed at enhancing our services for you. No sensitive information will be transferred for this purpose, and we will employ effective measures, such as data anonymization and pseudonymization, to reduce the sensitivity of the data being transferred.

7. COOKIES

  • 7.1. To personalize your experience and enhance your interactions with our services, we may send one or more small data files, known as Cookies, to your computer or mobile device. These Cookies can only be read by the web server of the domain that issued them to you. We use Cookies to streamline the login process, store your browsing preferences to provide tailored options, improve your ad preferences and interactions, and verify your login status and account or data security.
  • 7.2. We will not use Cookies for any purpose other than those described in this Privacy Policy. You may manage or delete Cookies according to your preferences. You can clear all Cookies saved on your computer, and while most web browsers accept Cookies by default, you can modify your browser settings to decline Cookies as needed. Additionally, you can clear all Cookies saved within applications. Please note that if you choose to delete or disable Cookies, you may need to manually reconfigure your settings upon each visit, any stored information may be lost, and this may impact the security of the services you use.

8. DO NOT TRACK

  • Many web browsers offer a Do Not Track (DNT) feature that allows you to send a request to websites asking that they disable tracking of your online activities. Currently, no uniform standard has been adopted by the major internet standards bodies to govern how websites should respond to DNT requests. However, if your browser’s Do Not Track feature is enabled, our websites will respect your preference.

9. EXTERNAL LINKS

  • Please note that BuildMost contains links to third party sites and if you navigate to a third-party site from BuildMost, any data you provide to that site and any use of that data by the third party are not under the control of us and are not subject to this Policy. You should consult the privacy policies of each site you visit.

10. YOUR RIGHTS

  • 10.1. As a Platform user, you may have the following data protection rights, which you can exercise under applicable laws by contacting us via the details in section 17, “HOW TO CONTACT US” , below:
    • Right to access, correct, update, or request deletion of your personal information.
    • Right to object to processing of your personal information when based on our legitimate interests, and separately, the right to object to direct marketing.
    • Right to request restricted processing of your personal information, or in some cases, request data portability.
    • Right to opt out of marketing communications we send at any time. You can exercise this right by clicking on the “unsubscribe” or “opt-out” link in our marketing emails. To opt out of other types of marketing (such as postal or telemarketing), please contact us using the details provided in section 17, “HOW TO CONTACT US”, below.
    • Right to withdraw consent at any time if we process your personal information based on consent. Withdrawal will not affect the lawfulness of any prior processing, nor any processing conducted on other lawful grounds.
    • Right to lodge a complaint with a data protection authority about our collection and use of your personal information. For more information, please contact your local authority. If you are in the European Union, the main supervisory authority is the Garante per la protezione dei dati personali in Italy.
  • 10.2. We respond to all requests to exercise data protection rights in accordance with applicable laws. If your jurisdiction allows a right to appeal a denied request, you may submit an appeal using the contact details in section 17, “HOW TO CONTACT US” , below.
  • 10.3. If you notice changes or inaccuracies in your information, please inform us so we can update or correct our records.

11. MINORS

  • 11.1. The Platform is intended for adults. Our Platform is not directed to and we do not intend to, or knowingly, collect, or solicit personal information online from Users under the age of 18 ( “Minors”).
  • 11.2. We do not intend to sell any of our products or services to Minors. If a Minor has provided us with personal information without parental or guardian consent, the parent or guardian should contact service@buildmost.com to remove the information.

12. SECURITY MEASURES

  • 12.1. We implement appropriate technical and organisational measures to prevent unauthorized access to the Platform, to maintain data accuracy and to ensure the correct use of the information we hold.
  • 12.2. For registered Users of the Platform, some of your information can be viewed and edited through your account, which is protected by a password. It is your responsibility to keep your password secure and confidential. You must not divulge your password to anyone. Our personnel will never ask you for your password in an unsolicited phone call or in an unsolicited email. If you share a computer with others, you should not save your log-in information (e.g., user ID and password) on that shared computer. Remember to sign out of your account and close your browser window when you have finished your session.
  • 12.3. No data transmission over the internet or any wireless network can be guaranteed to be perfectly secure. As a result, while we use appropriate technical and organizational measures to protect the information we hold for you, we cannot guarantee the security of any information you transmit to us and you do so at your own risk.

13. SPECIFIC PROVISIONS FOR EU, EEA AND UK USERS

  • 13.1. This section of the Privacy Policy applies to you if you are in the EU, the European Economic Area (EEA) or UK.
  • 13.2. The Controller (within the meaning of the EU and UK General Data Protection Regulation (“GDPR”)) for the processing of personal data as described in this Privacy policy is: YEKALON HK LIMITED., Unit 19, 9th Floor, One Midtown, 11 Hoi Shing Road, Kwai Chung, Hong Kong.
  • 13.3. Under applicable EU regulation, you have the following rights in respect of your personal information:
    • to obtain information about how and on what basis your personal information is processed and to obtain a copy;
    • to rectify inaccurate personal information;
    • to erase your personal information in limited circumstances where (a) you believe that it is no longer necessary for us to hold your personal information; (b) we are processing your personal information on the basis of legitimate interests and you object to such processing, and we cannot demonstrate an overriding legitimate ground for the processing; (c) where you have provided your personal information to us with your consent and you wish to withdraw your consent and there is no other ground under which we can process your personal information; and (d) where you believe the personal information we hold about you is being unlawfully processed by us;
    • to restrict processing of your personal information where: (a) the accuracy of the personal information is contested; (b) the processing is unlawful but you object to the erasure of the personal information; (c) we no longer require the personal information for the purposes for which it was collected, but it is required for the establishment, exercise or defence of a legal claim or (d) you have objected to us processing your personal information based on our legitimate interests and we are considering your objection;
    • to object to decisions which are based solely on automated processing or profiling;
    • where you have provided your personal information to us with your consent, to ask us for a copy of this data in a structured, machine-readable format and to ask us to share (port) this data to another data controller; or
    • to obtain a copy of or access to safeguards under which your personal information is transferred outside of the EEA.
  • 13.4. Under certain circumstances, you may have the right to object, on grounds relating to your particular situation, to the processing of your personal data by us and we may be required to no longer process your personal data. Moreover, if your personal data is processed for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for such marketing, which includes profiling to the extent that it is related to such direct marketing. In this case your personal data will no longer be processed for such purposes by us.
  • 13.5. To exercise your rights please contact us as stated in section 17, “HOW TO CONTACT US” below.
  • 13.6. In addition to the above, you have the right to lodge a complaint with a supervisory authority for data protection. Please note that the right of access and the right to erasure do not constitute absolute rights and the interests of other individuals may restrict your right of access or erase in accordance with local laws.
  • 13.7. We will ask you for additional data to confirm your identity and for security purposes, before disclosing data requested by you. We reserve the right to charge a fee where permitted by law. We will decline to process requests that jeopardize the privacy of others, are extremely impractical, or would cause us to take any action that is not permissible under applicable laws. Additionally, as permitted by applicable laws, we will retain where necessary certain personal information for a limited period of time for record-keeping, accounting and fraud prevention purposes.

14. SPECIFIC PROVISIONS FOR THE UNITED STATES USERS

15. SPECIFIC PROVISIONS FOR BRAZIL USERS

  • 15.1. This section of the Privacy Policy applies to you if you are in Brazil.
  • 15.2. Legal Basis for Data Processing

    15.2.1. If you are a User from Brazil, our legitimacy for the processing of personal data may include the following bases:

    • Contract performance: necessary for providing the services pursuant to the agreement between you and us and our affiliates (for example, to provide you with the services you request and to identify and authenticate you so you may use the Platform).
    • Your consent: when we seek your consent prior to processing your personal information a specific purpose that we communicate to you. You may withdraw your consent at any time and we will stop processing your data for that purpose;
    • compliance with legal requirements: necessary to comply with legal requirements (for example, to comply with applicable accounting rules and to make mandatory disclosures to law enforcement);
    • our legitimate interest and interest of users: necessary for our legitimate interests and not overridden by your rights (for example, to detect and prevent fraud and abuse in order to protect the safety of the Users);
    • necessary for the regular exercise of rights on legal, administrative or arbitral action; and/or
    • necessary for credit protection.
